  • The article ¡° Electronic Money and Rel eva nt Legal and Regulatory Issues¡± written by Chambers Yang, Partner of Haworth & Lexon, was published in the book ¡°Cash to Plastic: Issues and Perspectives¡± , one of the ICFAI Books.

    The article ¡° Electronic Money and Relevant Legal and Regulatory Issues¡± describes the legal implications of using plastic for payments as well as the regulatory framework for e-money with detailed discussion about the regulation of e-money in the UK as well as PayPal, or electronic money transfer services to anyone who has a valid e-mail account.

    The Icfai University represents the multi-state network of universities in India , sponsored by the Institute of Chartered Financial Analysts of India.

    Icfai Books is the initiative of the Icfai University Press to publish a series of professional books in the areas of accounting, banking, insurance, finance, marketing, operations, HRM, law, IT, management and allied areas with a special focus on emerging and frontier themes.   • Haworth & Lexon succeeded in the company dissolution case at a higher people's court which is the first one after the new ¡°Company Law¡± went into effective

    In February, 2006, Haworth & Lexon, represented a large stated-owned enterprise, brought the lawsuit to claim to dissolve a joint venture company set up by the stated-owned enterprise and a private enterprise. At the beginning of December, 2006, we got the judgment from Jiangxi Higher People's Court which supported our claim to dissolve the company. This is the first case to judge on the dissolution of company by a provincial court after the implementation of ¡°Company Law¡± on January 1, 2006, which has significant effects in interpretation and application of the law.

    On the morning of 7 Dec. 2006, partner Mr. Dermot Zhang made a comprehensive discussion with Mr. Anthony Germain of CBC (Canadian Broadcasting Corporation) on issues arising from fair competition and other related topics. During the recorded interview, Mr. Zhang lay out his views from wide perspective points, such as legislation, culture, social response, good citizen, anti-corruption, self discipline, commercial competition, Guanxi's influence, detecting techniques etc. To suggest some effective approaches, Mr. Zhang expressed his package solutions to multinational companies who are doing and will do their business in China.

  • Mr. Chambers, Yang, Partner of Haworth & Lexon, was interviewed by the reporters of ¡°IT Times¡±, on the issues of protection of copyrights of the works on the WAP

    On the serious issue of infringement on the copyrights of the works on the WAP, and the different attitudes and opinions of the WAP operators, the Reporters of ¡°IT Times¡± interviewed Mr. Chambers Yang, partner of Haworth & Lexon. Mr. Yang analyzed the background and actuality of infringement on copyrights of the works on the WAP and introduced the legislation of propagating right of information, and judicial and administrative protection.

  • Mr. Chambers, Yang, Partner of Haworth & Lexon, was interviewed by the reporters of ¡° China Business Network Daily¡±, on the issues of abuse of intellectual property and anti-monopoly

    The Reporters of ¡°China Business Network Daily¡± interviewed Mr. Chambers Yang on the issues of limitation of action, protection of intellectual property and monopoly of knowledge. Mr. Yang introduced the laws and regulations and legal practice on the relevant trial period of intellectual property cases, mainly various remedies for right holders which could be used in the long-term cases. He also gave his opinions on the relations among abuse of intellectual property and anti-monopoly, protection of intellectual property and opposing arbitrary rights on knowledge.

  • Haworth & Lexon won a competitive bidding for the legal service of overseas investment and trade

    Haworth & Lexon has recently signed a legal service retainer agreement with Zhejiang Huayou Cobalt Nickel Materials Co., Ltd on the issues of providing the company with legal service for its overseas investment and trade.

    Zhejiang Huayou Cobalt Nickel Materials Co., Ltd. is a manufacturer specialized in the smelting of cobalt, nickel and copper with wet method and the processing of the new chemical materials. It is one of the most influential enterprises in the cobalt and nickel chemical industry at home and abroad. The company has launched large-scale overseas investment in the recent years. To ensure the smooth engagement of the investment and trade, Huayou invited Haworth & Lexon and some notable law offices from Shanghai and Hangzhou to take part in the competitive bidding for legal services. A legal service group of Haworth & Lexon consisting of Partners Mr Chamber Yang, Mr Dermot Zhang, Mr Tony Zhong and other lawyers and assistant lawyers took part in it and finally won the bid.

  • Mr. Chambers Yang, partner of Haworth & Lexon attended the experts meeting of the Donghai Bridge Offshore Wind Energy Farm Project in Shanghai

    The experts meeting of the Donghai Bridge Offshore Wind Energy Farm Project was held in Luo Xingge Hotel in Jiashan of Zhejiang province from 3 to 4 August, 2006. This meeting was organized by Shanghai Development and Reform Committee. Mr. Yang was invited as the legal expert. The experts argued and demonstrated on the relevant issues concerning the project's BOT bid. The Donghai Bridge Offshore Wind Energy Farm Project is the largest of its kind in China and has great significance on the development of the renewable resources for Shanghai and for China as well.

    Mr Chambers Yang, partner of Haworth & Lexon was recently interviewed by reporter of ¡° The Wall Street Journal¡±. Mr Yang answered their questions and expressed his views on the law application of the newly published ¡° Notice on the strengthening of the management of foreign investment and operation on the value added telecommunication business¡±, the usual mode of the foreign investment into Chinese telecommunication, the relationship between the domain name authorization, trademark authorization and the direct foreign investment and the merger & acquisition of foreign funds, the possible effect of foreign investment into the Chinese value added telecommunication business, etc.

    Mr. Tony Zhong, partner of Haworth & Lexon is engaged by Shanghai Cultural Development Foundation as Expert of Inspection & Supervision, undertaking supervision and consultation for the granted projects of the Foundation. Shanghai Cultural Development Foundation was founded in November 1986 in response to the strategic development of culture in Shanghai . It was one of the first few regional organizations of this kind in China , and is now one of the largest and most influential foundations in Shanghai . Since September 2004, consigned by the government, the Foundation launched the project grants toward the whole society. Up to now, three rounds of project grants have been carried out, including 1078 applied projects, and 237 projects approved and granted. The total sum of the granting is nearly 120 million. To supervise he actual situation of implementation, the use of funds and expected effects, etc., the Foundation has established a consulting expert database. Experts with both high academic statuses in culture and art circle and rich experiences in operations of cultural market are in charge of analyzing and suggesting the inspecting and supervision proposal for the grants.

She is experienced in Large Project Construction, Real Estate Development, Construction, Banking, and Corporate Management.   • Partner Dermot Zhang and Rafer Young of the Firm Gave a Debating Speech to Audience in the American Chamber of Commerce in Shanghai regarding Landlord Versus Tenant Rights, at JW Marriott Hotel.

    Invited by the American Chamber of Commerce in Shanghai, (referred to Amcham), on the evening of 21 Apr. 2006, Mr. Dermot Zhang and foreign legal consultant Rafer Young delivered a debating speech regarding Landlord versus Tenant Rights at JW Marriott Hotel.

    The debate model was adopted to clearly demonstrate the topic issues focusing mainly on the validity of Letter of Offer, conclusion of a lease agreement, main rights of landlord and tenant, first refusal right, establishment of price, landlord's responsibility in relationship with neighboring landlord and its tenant, nosy pollution, usual remedies of tenant etc.

    Counter party's representing lawyer is partner David Liu. During the Q & A section, Dermot comprehensively delivered his answers and suggestions basing on his extensively relevant experiences.

    The function was organized by the Real Estate Committee of Amcham. During the debate, the moderate was Ms. Nicole Paulson Washko, general manager of Pricoa Consulting ( Shanghai ) Co. , Ld of the Pricoa Financial Group. The anchor was Mr. Michael T. Hart, assistant director of Jones Lang Lasalle in north Asia region.

  • Our Partner/attorney, Tony Zhong, Lily Jiang was Invited to Give a Speech on EU anti-dumping Law in a county in Zhejiang province.

    Whereas some furniture producers in Italy applied to EU to impose anti-dumping tax on the furniture exported from China, our partner/attorney Tony Zhong and Lily Jiang were invited by the Foreign and Trade Cooperative Bureau of a furniture-exported county in Zhejiang province and gave training courses in April, 2006, which was attended by the general managers and financial managers from more than 20 furniture companies. The content includes the importance of defense by enterprises, the strategies of defense, how to fill in the anti-dumping questionnaires and what defending reasons can be used in anti-dumping cases.

  • Mr. Chambers Yang, partner of Haworth & Lexon, was invited to give a key-note speech at " 2006 China Tax Conference" in Singapore .

    CHINA TAX '06 was held at Inter Continental Hotel Singapore on March 8, 2006, and Mr. Chambers Yang was invited to attend this Conference and give a key-note speech on the topic of Foreign Investment Regulations in China . The present guests had a detailed communication with Mr. Yang on the investment vehicles, business scope, financing of foreign invested companies and etc. This Conference was held by Key Media Conferences. The officials from Inland Revenue Authority of Singapore and the general managers, financial managers, taxation managers or other management personnel from Singapore Petroleum, Singapore Telecom and other famous companies attended this Conference. The representatives from some well-known law firms such as Baker Mckenzie and Lehman, Lee & Xu also gave the regarding speeches at the Conference.

  • Mr. Chambers Yang, partner of Haworth & Lexon, was interviewed by reporter of IT-Times on the legal issues of Monternet.

    China Mobile Co., Limited put forward a series of policies these days for the containment of free WAP websites, which brings these free WAP websites to a serious crisis. The reporter from IT-Times interviewed Mr. Chambers Yang for the concerned problems. Mr. Yang analyzed the rights and obligations of the parties of Monternet, pointed out the legal principles each party shall comply with and gave his own opinions on the laws and regulations on Monternet.
